Azerbaijan, Baku, 23 July / corr. Trend K.Zarbaliyeva / The Azerbaijani Constitutional Court commented on 83.2 Article of the Criminal Code.
According to this Article, individuals, being released from punishment issued by the court, are not considered as tried persons.
Ganja Court of Kapaz District appealed to the Constitutional Court with the request to specify rules to apply the Article.
Under this decision, persons, who are not sentenced to a punishment term after the expiration of limitation for bringing an action and freed from punishment in accordance with amnesty act, are considered as untried.
