Ratifying the Convention on Cybercrime in Azerbaijan will impose relevant requirements before Internet providers to improve the technical basis for the implementation of network monitoring, chief of human resources and legal department of the Ministry of Communications and Information Technologies of Azerbaijan Bakhtiyar Mammadov said in an interview with journalists.
According to Mammadov, the convention is now in force and it will be implemented in phases.
Internet providers will have to step up cooperation with law-enforcement agencies to more effectively combat cybercrime. Only cooperation can be a basis for combating undesirable incidents on the Internet. Certainly, the project to monitor all contents requires huge investments. But without the support of legal service and legal authorities, combating in this direction is not possible, said Mammadov.
It is known that the Internet provider has data on information exchange messages, which can be obtained by using equipment that records the specific aspects of information exchange, including time, duration and date of the message. These data are generally kept for a limited period of time, depending on the commercial needs of the service provider, as well as the legal requirements for privacy protection. Many national laws allow law enforcement or judicial authorities to order the collection of these data.
The important is the item of the convention which gives an opportunity to take legislative and other measures authorizing to seize or similarly secure destruction of data that the provider has and are necessary for the investigation.
