Copyright Agency: Azerbaijan's legislation on combating piracy should be improved

The Azerbaijani legislation on combating piracy of intellectual property should be improved, the Azerbaijani Academy of Science's (ANAS) Information Technology Institute (ITI) quoted Copyright Agency Chairman Kamran Imanov.

Imanovaid today the level of piracy of intellectual property is high in Azerbaijan and this requires implementation of administrative and organizational measures.

The agency has already developed a bill "On ensuring the intellectual property rights and combat piracy" and coordinated it with several governmental agencies, after which submitted the bill to the Cabinet of Ministers.

The bill is intended to regulate issues of protection of the rights holders of intellectual property, determine the administrative and judicial proceedings related to the protection of their interests and prevent crime.

The third chapter of the law fully related to the fight against piracy. This chapter reflects specific rules relating to the digital encoding works, phonograms and other intellectual property. The law would also prevent the illegal use of information technology.

Imanov said this is inevitable due to the increasing pace of economic development of intellectual property rights and acceleration of the integration of intellectual property in a system of e- commerce.

In accordance with the law, the court may make decisions on the prevention of admission to online trading pirated copies or counterfeit goods illegally imported by violating intellectual property rights, and fine persons, intentionally or unknown violating intellectual property rights for compensation for damage to the right holder.

However, the court by the offender may seize and destroy counterfeit products out of retail outlets, as well as to remove the equipment and materials used in the production of illegal goods without payment of compensation and not contradicting the terms of the existing legislation.
