FINA LLP, a law firm representing the Software Alliance (BSA), appealed to the Azerbaijani authorities with a proposal to amend the legislation on copyright protection, Nariman Ramazanov, head of the firm, told Trend Oct. 27.
He said that it is proposed to amend the legislation and form an agency responsible for resolving issues of software piracy by carrying out checks to identify the use of pirated software in enterprises.
“Collection of evidence is a major problem,” Ramazanov said. “For example, in European countries and the US, a legal company anonymously appeals to a court where an expert group is created, without informing a company suspected of using pirated software. The expert group unexpectedly visits the company during the working time in order to check the licenses of the software used. When use of pirated software is identified, a protocol is drawn up and sent to the court. This is not provided by law in Azerbaijan. The visit should be unexpected, so that the opposite side couldn’t hide the fact of license violation.”
