An Austrian judge ruled Monday that former Croatian premier Ivo Sanader may be extradited to his home country on corruption charges, reported dpa.
Sanader's lawyer said he would appeal the decision, thus delaying the extradition and prolonging his client's detention.
The former politician was arrested in Austria on December 10 on a Croatian warrant linking him to alleged corruption, embezzlement and other crimes.
Sanader's lawyer Werner Suppan argued that his client should not be handed over to Croatia because he would not get a fair trial there.
Sanader was prime minister between 2004-09.
