The opposition Azerbaijan Democratic Party (ADP) intends to bring an action against Zakir Garalov, the General Public Prosecutor, for exceeding of authority, Sardar Jalaloglu, the deputy chairman of the ADP, told Trend.
He noted that the Garalov exceeded his authority depriving Rasul Guliyev, the ex-speaker balloting for the parliamentary elections, of privilege from arrest at accusation in misappropriation of state property.
27 August Guliyev was registered as a candidate for deputy at the forthcoming 6 November parliamentary elections. The Public Prosecutor’s Office gave instructions to the Ministry of Internal Affairs to arrest the politician in case of repatriation.
The law-enforcement bodies accused Guliyev in misappropriation of state property in the amount of $107 million and sanctioned his arrest after ex-speaker’s leaving for the United States in 1996.
“It is illegal sentence. The General public Prosecutor’s Office doesn’t have the right to raise the privilege from arrest installed by the Azerbaijani Elections Code for registered candidates and we are going to bring an action against the prosecutor to the Sabail district court for exceeding of authority,” the deputy chairman of the party stressed.
“Candidate’s privilege from arrest may be raised if he breaks the law after the registration of his candidacy. The Khatai district electoral committee issued Guliyev a mandate as a candidate for deputy at the 6 November elections on 27 August, while he emigrated in the United States and did not commit any crime in Azerbaijan,” Jalaloglu underlined.
The ADP addressed to Ilham Aliyev, the Azerbaijani President, with request to take measures in regard to Garalov, who interfered into the elections process.
“It was done to hinder Guliyev to repatriate and win at the elections. However, he will come despite expecting provocations by law-enforcement bodies,” he noted.
According to Jalaloglu, decision on repatriation of Guliyev will be made by the leadership of the party in a week.
