European Court recommends to register Azerbaijan Lawyers Forum

Azerbaijan, Baku, Dec. 18 / Trend , K.Zarbaliyeva/ Om Dec. 18, the European Court made a decision on complaints of founders of the Azerbaijan Lawyers Forum, whose registration has been rejected.

In accordance with the decision of the European Court on Human Rights, the court recognized violation of the 11th Article (right of unification) of the Convention and recommended the government to eliminate this violation.

The Azerbaijan Lawyers Forum (ALF) was established on May 24 in 2003 at a decision of the ALF founders' general meeting and since then, legal procedures have been implemented for registration.

Founding documents of the Forum has been submitted to the Juridical Figures State Registration Department of the Azerbaijani Justice Ministry for state registration on Jun. 23 in 2003. At that time, the Justice Ministry roughly violated requirements of legislation on state registration of juridical figures and kept the documents at the Ministry without fulfillment within seven months: neither registered the organization, nor refused to register it.

The ALF appealed to Yasamal District Court because of recognition of refusal from granting certificate for state registration as illegal and violation of the 11th Article of the Convention on protection human rights and major freedom in March 2004. Yasamal District Court, Court of Appeal and Cassation rejected the complaint. Lawyers have sent an appeal to the European Court on violation of Articles 6 (right of fair juridical investigation), 11 (right of unification) and 13 (right for useful protection means) of the European Convention.

This is the 16th decision of the European Court concerning Azerbaijan and the fourth - on registration.
