Guantanamo prisoner "in legal limbo" in Spain

A Palestinian from the US prison facility in Guantanamo, Cuba, is living in a legal limbo in Spain, the daily El Pais said Monday.

Walid Jihazi, 30, arrived in Spain more than a month ago after spending eight years in Guantanamo. He was the first among five Guantanamo inmates that Spain has accepted to receive to help US President Barack Obama close the prison camp, DPA reported.

However, Jihazi's legal situation in Spain is as irregular as it was in Guantanamo, the daily said.

Jihazi is not an illegal immigrant, nor is he in custody, nor are there any criminal charges against him.

Yet his whereabouts are being kept secret even from his family and lawyer, and no information has been given on whether he will be able to return to the Palestinian territories.

Such a situation has no basis in the Spanish legislation, El Pais said.
