One More Appeal Submitted against Azerbaijan to European Court

Azerbaijan, Baku, 13 May / Trend corr. K.Zarbaliyeva / Lawyer Annagi Hajibayli, has made a court appeal to the Europen Court as the Constitutional Court illegally rejected to consider his appeal.

Intigam Aliyev, Hajibayli's rights protector, stated that the Constitutional Court has rejected to consider his appeal on violation of rights and freedom of his client, while considering the lawsuit on illegal refusal from his membership in the Bar in the local courts.

Since November 2006, the official registration of membership of licensed lawyers in the Bar has been started. Under the changes made into the Bill on 'Lawyers and lawyers' activity', all persons who get license should be accepted into the Bar without qualification tests from 3 June 2005. However, Hajibayli's appeal was rejected in the meeting of the Bar Presidium on 26 January 2006. Lawyer has appealed against Bar for arbitrary behavior.

Constitutional Court also refused to consider the appeal by Hajibayli.

Hajibayli evaluated this rejection as a violation of the Azerbaijani legislation and Article 6 of the European Convention on right for fair trial, and has now sued the Azerbaijan in the Strasburg-based Court.

Hajibayli made a court appeal against Azerbaijan due to the rejection to accept him as a member in January 2008. The appeal said violation of the Article 6 (right for fair trial), 10 (freedom of opinion), 11 (freedom of unification) and 14 (prohibition of discrimination).
